Affordable Care Act Workshop - POSTPONED

The Affordable Care Act Workshop, originally scheduled for January 23, was postponed to allow time for the IRS to issue its final regulations.     

 

This is a dues-supported session for our affiliated credit unions.   Although there's no charge to attend, please take a minute to complete the registration process.     

 

The Patient Protection and Affordable Care Act requires that large employers provide adequate and affordable health benefits to all “full-time” employees or pay non-deductible penalties (often referred to as the employer mandate or “shared responsibility” provision).


 

Last December the IRS issued proposed regulations on the mandate (Section 4980H of the Internal Revenue Code), but let many important issues unanswered.  Adding further confusion, on July 2, 2013, the IRS delayed the effective date of the mandate from 2014 to 2015 without providing any guidance with respect to how the delay might impact the “transitional rules” in the proposed regulations.

The IRS is expected to issue comprehensive final regulations in the last weeks of 2013 which will clarify many, if not most, of the open issues. It is extremely important for employers to understand the final rules in order to begin preparing immediately for the 2015 mandate implementation, including:

  • Are you (or can you become) a “small” employer exempt from the mandate?
  • How do you count employees and hours and determine “full-time” employees and full-time equivalent employees?
  • How do “large” employers take maximum advantage of the look-back measurement period?
  • What coverage do large employers need to offer to avoid penalties?
  • How are penalties calculated and assessed?
  • What new reporting requirements will employers suffer?
  • What strategies are available to minimize or avoid the mandate penalties?

He has more than 39 years of experience as both a practicing attorney and CPA in the areas of retirement plans and employee benefits.  His employee benefits practice focuses on creative retirement plan design, particularly 401(k) and cash balance pension plans, and all aspects of Health Care Reform, particularly planning for the employer mandate.
