Appeals Court Halts Reinstatement of NCUA Board Members Harper and Otsuka
A federal appeals court late Friday, issued an emergency stay blocking the reinstatement of former NCUA Board Members Todd Harper and Tanya Otsuka. The decision pauses a lower court ruling from earlier in the week that found their April dismissal by former President Donald Trump to be unlawful and inconsistent with Congressional intent.
Following the judge’s decision on Tuesday, Harper and Otsuka had resumed their positions and participated in the NCUA Board meeting on Thursday. However, the appeals court’s stay now sidelines them once again while the case proceeds.
Harper and Otsuka must respond to the administration’s emergency motion for a stay by August 4, with a reply due by August 11.
