DC Council Introduces ‘Fair Swipe Act of 2025’ to Limit Interchange Fees

Councilmember Charles Allen has introduced the Fair Swipe Act of 2025 (B26-0138), a bill modeled off of the Illinois Interchange Fee Prohibition Act (IFPA) aimed at prohibiting interchange fees on the sales tax and gratuity portions of credit and debit card transactions.

Interestingly, and likely due to the litigation in Illinois, this bill has a non-severability clause that states unless this bill impacts all financial institutions, it is null and void. The legislation is co-sponsored by Councilmembers Wendell Felder, Matthew Frumin, Christina Henderson, Janeese Lewis George, Brianne K. Nadeau, Brooke Pinto, and Robert C. White, Jr.

This bill builds on similar efforts by Allen, who introduced a similar measure last year. The Association has been working with a coalition over the last few months anticipating the introduction, and will vigorously oppose as it moves through the legislative process.
